PROCESSED PERSONAL DATA

In the scope of our activities, we may process personal data obtained from you or from public sources. If you collaborate with us as an IT expert, whose services we provide to our clients, we may process information such as your name, address, date of birth, email, phone number, bank account number, ID and VAT ID, details of work experience, completed courses, and other professional information, availability, financial requirements, evaluations, education, and all of this to fulfill our contract with you and offer tasks that match your skills, knowledge, experience, and expertise.

If you are our client, we may process the names and surnames of you or your employees, including their job position, address, date of birth, email, phone number, bank account number, ID and VAT ID, IP addresses, and communication records related to provided services, all to fulfill our contract with you and inform you about our business updates, which is our legitimate interest. You can, of course, unsubscribe from our updates anytime via the link in the received email.

If you applied for any of our internal job positions, we may process your name, surname, address, date of birth, email, phone number, professional information, availability, financial requirements, education, etc., to evaluate whether we can offer you employment at our company.

If we intend to share your data with partners or inform you about updates not directly related to our products, we will always ask for your consent.

PURPOSES AND LEGAL BASIS FOR DATA PROCESSING AND RETENTION PERIOD

We will retain your data for the duration of their processing purpose, during the contract’s validity, and further based on applicable legal requirements (especially accounting and VAT laws) or our legitimate interest for the protection of our rights in cases of complaints or potential disputes, within the relevant limitation periods. For more details, don’t hesitate to contact us.

WHO PROCESSES YOUR PERSONAL DATA AND WHOM DO WE SHARE IT WITH?

As the data controller, we process all the above-mentioned personal data. This means we determine the purposes for which we collect your personal data, set the means of processing, and are responsible for its proper execution.

In general, we do not share your personal data with other data controllers. Exceptions may occur when we are legally obliged to share this data (especially with social security authorities, financial authorities, courts, and police in the exercise of their legal powers).

We may use data processors as IT providers who assist us with the operation of our infrastructure and systems or help us achieve analytical or similar goals.

TRANSFER OF YOUR PERSONAL DATA OUTSIDE THE EUROPEAN ECONOMIC AREA

We may transfer your personal data to third countries outside the European Economic Area, which do not provide an adequate level of personal data protection. Any such transfer will be carried out only if the relevant processor agrees to comply with the standard contractual clauses issued by the European Commission, available at https://eur-lex.europa.eu/legal-content/EN/TXT/PDF/?uri=CELEX:32001D0497&from=EN.

WHAT ARE YOUR RIGHTS REGARDING PERSONAL DATA PROCESSING?

Just as we have rights and obligations when processing your personal data, you also have certain rights related to the processing of your personal data. These rights include:

Right to access personal data - You have the right to know what data about you we process, for what purposes, how long, where we obtained your personal data, whom we share it with, who processes it besides us, and what other rights you have related to the processing. All of this has already been explained in these privacy policy statements. If you are unsure what personal data about you we process, you can ask us to confirm whether we process personal data concerning you, and if so, you have the right to access this data. Based on the right to access personal data, you can request a copy of the processed personal data, with the first copy provided free of charge and subsequent copies subject to a fee.

Right to rectification - If you find that the personal data processed by us relating to you are inaccurate or incomplete, you have the right to rectify or complete them without undue delay.

Right to erasure - In certain cases, you have the right to erasure of your personal data. We will erase your personal data without undue delay if any of the following reasons occur:

  • We no longer need your personal data for the purposes for which we processed them.
  • You exercise the right to object to processing (see section “Right to object to processing” below) concerning personal data processed based on our legitimate interests, and we find that the legitimate interests justifying such processing no longer exist.
  • Our processing of personal data no longer complies with the applicable legal regulations.

This right cannot be exercised if the processing of your personal data is still necessary for fulfilling our legal obligations, archiving purposes, scientific or historical research, or for statistical purposes, or for establishing, exercising, or defending legal claims.

Right to restriction of processing - In certain cases, in addition to the right to erasure, you can also exercise the right to restrict the processing of personal data. This right allows you, in specific cases, to request that your personal data be marked and not further processed – however, not permanently (unlike the right to erasure), but for a limited period. We must restrict the processing of personal data when:

  • You dispute the accuracy of personal data, and this will be restricted until we agree on the correct data.
  • We process your personal data without sufficient legal grounds (beyond what we are legally required to process), but you would prefer their restriction before erasure (for example, if you intend to provide this data in the future).
  • We no longer need your personal data for the aforementioned processing purposes, but you request further processing due to establishing, exercising, or defending your legal claims.
  • You raise an objection to processing. The right to object to processing is further detailed in the section titled “Right to object to processing.” If your claim is justified, we must restrict the processing of your personal data for the period during which we retain your data.

Right to object to processing - You have the right to object to the processing of personal data based on our legitimate interests. If you object, we will no longer process your personal data unless we have compelling legitimate reasons for further processing.

Right to lodge a complaint - Exercising the above-mentioned rights does not affect your right to lodge a complaint with the Office for Personal Data Protection. You can exercise this right, especially if you believe that we process your personal data unlawfully or in violation of generally binding legal regulations.

HOW CAN YOU EXERCISE YOUR INDIVIDUAL RIGHTS?

For all matters related to the processing of your personal data, whether it’s a question, exercising rights, filing a complaint, or anything else, you can contact us at info@codedock.cz or by mail at: CodeDock s.r.o., Zlenická 863/9, Prague 22, 104 00.

We will process your request without undue delay, but no later than within one month. In exceptional cases, especially due to the complexity of your request, we may extend this period by another two months. Of course, we will inform you about any such extension and its reason.
